Parole Representation in Texas

What is parole?

Parole is the discretionary release of a prisoner.  The Texas Board of Pardons and Paroles decides on parole by a majority vote of a panel of three members.

The parole review process

  • The Parole Division identifies those who are initially eligible for parole six months prior to their eligibility dates.
  • For those who have been previously denied parole, the Parole Division identifies their eligibility four months prior to their next review date.
  • A notice is sent to trial officials, victims, and victims’ family members.
  • A parole officer interviews the offender and prepares a parole case summary.
  • If the offender is represented by Texas parole lawyer, Kevin Stouwie, Mr. Stouwie submits a well-prepared written information packet to the Board Office.  Mr. Stouwie's experience determines the strategy and precise contents of the packet, which may include offers of trade school or college admission, employment offer letters, and letters of support from those who know the offender.
  • Three panel members are selected to review the parole application.
  • Parole panel members must grant an interview to victims upon request.
  • Although the offender may be interviewed by a member of the panel, according to statistics compiled by the Texas Department of Criminal Justice (TDCJ), only two percent of offenders are actually interviewed by a member of the panel.
  • The offender’s file is sent to the appropriate Board Office.  (See office locations)
  • Granting interviews to individuals in support of or to protest an offender’s release is also at the parole panelists' discretion.
  • If the offender is represented by Kevin Stouwie, Mr. Stouwie personally advocates on the offender's behalf directly to the lead voter on the case.  This is done in person or by telephone, at the parole panelist's discretion.
  • The first voting panelist reviews the application and votes.  (See choices)
  • The file is transferred to the second voting panelist, who reviews the application and votes.
  • If the votes are similar, the decision becomes final.
  • If the votes differ, the file is transferred to the third voting panelist.
  • There must be a majority of two votes for a vote to become final.
  • The offender is notified of the parole panel decision via correspondence.
